HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8287 OF 2016 ORDER:

The writ petition is filed questioning the action of the 4th respondent-Tahsildar for not allocating the essential commodities for distribution to the petitioner's Shop No.19, Kannamadakala Village, Orvakal Mandal, Kurnool District.

The grievance of the petitioner is that by an order dated 15.02.2016, the 3rd respondent-R.D.O after conducting enquiry and considering the explanation submitted by the petitioner had compounded and dropped all the charges against the petitioner and restored the Fair Price Shop Dealership licence of the petitioner by imposing a fine of Rs.10,000/- on the petitioner. The learned counsel for the petitioner submits that even though the fine imposed on the petitioner had already been paid to the respondents-authorities, the 4th respondent-Tahsildar did not release the stock to the petitioner for distribution and hence he prays to allow the writ petition.

The facts are not in dispute. Learned Government Pleader for Civil Supplies (A.P), on instructions, submits that the 4th respondentTahsildar was not aware of the fact of compliance of the orders of the 3rd respondent-R.D.O. However, considering the order passed by the 3rd respondent-R.D.O, this Court may pass appropriate orders in accordance with law.

Having considered the material available on record and considering the respective submissions made by both the counsel and in the facts situation, the writ petition is disposed of directing the respondents-authorities to implement the order dated 15.02.2016 of the 3rd respondent-R.D.O forthwith by restoring the license in favour of the petitioner to enable him to distribute the essential commodities to the card holders.

Accordingly, the writ petition is disposed of. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
