HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6814 of 2016 O R D E R:- According to the petitioner, he was appointed as Dealer of Fair Price Shop No.27 of Narsingi Village, Rajendranagar Mandal, Ranga Reddy District, in the year 2012 and his authorization is valid up to 31.03.2016. He was also kept in-charge of Fair Price Shop No.2 by the 4th respondent vide proceedings No.C/28/15 dated 14.12.2015. While so, on 24.02.2016 the Deputy Tahsildar (Enforcement) and the Task Force Officer (Civil Supplies), Office of the District Supply Officer, Ranga Reddy District, inspected fair price shop No.2 and found certain irregularities and seized the entire stock available in the shop under cover of panchnama dated 24.02.2016.

Challenging the same, the present writ petition is filed.

The grievance of the petitioner is that though his authorization is subsisting up to 31.03.2016 and it is neither suspended nor cancelled, the respondents 3 and 4 are not supplying the essential commodities to his fair price shop for distribution of the same to the cardholders.

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.

In view of the fact that the authorization of the petitioner is still subsisting and the same is neither suspended nor cancelled and as 6-A proceedings are pending and in the facts and circumstances of the present case, interest of justice would be served if a direction is given to the 3rd respondent to complete the enquiry and the petitioner is allowed to distribute the essential commodities to the cardholders.

Accordingly, the Writ Petition is disposed of directing the 3rd respondent to complete the enquiry after issuing a show cause notice to the petitioner calling for explanation, within a period of four (4) weeks from the date of receipt of a copy of this order. Till such time, the respondents 3 and 4 shall supply the essential commodities to the fair price shop No.27 of the petitioner for distribution to the cardholders. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand dismissed. ___________________________ CHALLA KODANDA RAM, J 8th March, 2016 cbs
