This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief :

" To declare the action of the respondents in laying the Cement Road on the own agriculture lands of the petitioner to an extent of Ac.0.25 cents in R.S.No.85/ 4 and Ac.No.027 cents in R.S.No.85/ 3 and other land Ac.0.05, which is in our possession since above 60 yrs in R.S.No.85/ 3 towards southern side of above lands in Chavalipadu Village, Mandavalli Mandal, Krishna District as illegal, arbitrary and contrary to law.

Heard learned counsel for Respondent Nos. 6 and 7. Learned Assistant Government Pleader submits that the subject property is private land and if any action for laying the cement road in the land of the petitioner, the respondents would follow due procedure of law.

Recording the submission of the learned Assistant Government Pleader, this Writ Petition is disposed of and the respondents are directed not to evict the petitioner without following due process of law.

The miscellaneous Petitions, if any, pending in this case shall stand closed.
