ORDER
Heard learned counsel appearing for the petitioner, learned Government Pleader for Endowments appearing for respondents 1 to 3 and learned counsel appearing for the 4th respondent. Initially, the petitioner was appointed as Attender in the 4th respondent-temple on 29.10.2004 and thereafter, he was promoted as Record Assistant as per the orders of the 3rd respondent dated 30.11.2012. Subsequently, the petitioner passed M.A and he is fully qualified for promotion to the post of Junior Assistant. Since no Junior Assistant is working in the 4th respondent, the petitioner has been attending the clerical work and assisting the Executive Officer.
When he submitted a representation to the local public representative for consideration of his case for promotion, the 3rd respondent called for a report from the Executive Officer by proceedings dated 22.11.2014. Thereafter, the Executive Officer sent a report immediately to the 3rd respondent informing that there is an existing post and the petitioner is eligible for promotion. The 3rd respondent, in turn, sent a report to the 2nd respondent on 22.12.2014 stating that the petitioner is fully eligible and qualified and deserves to be promoted as Junior Assistant. The 2nd respondent appears to have raised query vide proceedings dated 12.2.2015 and the said query was also answered.
The grievance of the petitioner is that though there is a sanctioned post of Junior Assistant and he is fully qualified and eligible for promotion, the 2nd respondent did not take any action for consideration of his case for promotion to the post of Junior Assistant.
Learned Government Pleader appearing for respondents 1 to 3 submits that the 2nd respondent is the competent authority to grant permission for promoting the petitioner to the post of Junior Assistant.
In view of the fact that respondents 3 and 4 have already submitted their reports recommending the case of the petitioner for being promoted as Junior Assistant in the 4th respondenttemple, the 2nd respondent is directed to consider the said reports and pass appropriate orders thereon as expeditiously as possible, but not later than eight weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ____________________________________ JUSTICE A.RAMALINGESWARA RAO 2nd November, 2017 rkk
