HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.34736 OF 2017 O R D E R :

The grievance of the petitioner is that he retired from service while working as Junior Assistant in the establishment of Sri Varagani Group Temples, Varagani Village, Pedanandipadu Mandal, Guntur District on attaining superannuation on 31.07.2015. Thereafter, the petitioner submitted representation to the 3rd respondent seeking sanction of gratuity, in turn the 3rd respondent submitted a report to the 2nd respondent on 08.09.2015. Basing on the said report, the 2nd respondentCommissioner, Endowments Department has issued proceedings vide Dis.No.W3/21101/2015, dated 28.11.2015, sanctioning gratuity of Rs.4 lakhs.

Thereafter, the petitioner made representations to the 3rd and 4th respondents to comply with the orders passed by the 2nd respondent and release gratuity sanctioned to him. But, as on today, no action is being taken by the respondents even after a lapse of 2 years from the date of passing of order by the 2nd respondent. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Smt.K.Lalitha, learned standing counsel for the 4th respondent submits that the temple is registered under Section 6(C) of the Telangana Charitable Hindu Religious Institutions and Endowments Act, 1987, having low income and dependant on agricultural income; and that already an amount of Rs.1 lakh was

paid to the petitioner and the balance amount will be paid to the petitioner, if some reasonable time is granted to the temple. The same is opposed by the learned counsel for the petitioner stating that already amount is sanctioned to the petitioner in the year 2015, inspite of the same, the respondents are not paying the same to the petitioner.

In view of the aforesaid facts and circumstances, the respondents are directed to pay the balance amount to the petitioner within a period of three months from the date of receipt of a copy of this order, without fail.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 25.10.2017 t k.
