HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.34608 OF 2017 O R D E R :
The case of the petitioner is that he served as 'Senior Binder' in T.T.D Press and retired from service on superannuation with effect from 30.09.2015; and that even after lapse of two years from his retirement, he has not been paid retirement benefits and monthly pension. Aggrieved by the same, present writ petition is filed.
Learned counsel for the petitioner states that though suits are filed against the petitioner and orders are passed attaching some retirement benefits of the petitioner, the balance retirement amounts are not being paid to the petitioner.
Sri Sivaraju Srinivas, learned Standing Counsel for TTD submits that garnishee orders are issued against the respondent Organisation for certain amounts. He produced proceedings vide Roc.No.A16/9641/CAO/GPF/2016, dated 22.12.2016 stating that the amounts towards GPF accumulations has already been paid to the petitioner; and also proceedings dated 23.12.2016 stating that an amount of Rs.30,000/- was sanctioned to the petitioner towards settlement of Employees Welfare Fund; and that an amount of Rs.7,868/- was credited to the petitioner's account in July 2017 towards GIS claim. He also produced proceedings dated
17.10.2017 in Roc.No.P3/173/Press/Tpt/2015 wherein the respondents asked the petitioner to comply with certain conditions to settle the pension.
It is to be seen that some amounts of retirement benefits are already paid to the petitioner and petitioner was also asked to comply with certain conditions for release of pension. In view of the same, it is open for the petitioner to comply with such conditions laid down in the letter dated 17.10.2017, and on such compliance the respondent authorities are directed to release the pension and balance retirement benefits, if any, after deducting the amounts towards attachment arising out of garnishee orders passed against the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 25.10.2017 t k.
