THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.37998 of 2017 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief/ s: '..to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondents 2 and 3 in interfering with the petitioner's petty shop running at D.No.1-116, Gugudu Village, Narpala Mandal, Ananthapuram District as illegal, arbitrary, violation of Articles 14, 19(1)(g), 21 and 300-A of the Constitution of India and violation of principles of natural justice and consequently direct the respondents 2 and 3 from interfering with the petitioner's day to day activities in running a petty shop and pass such other order...' I have heard the submissions of the learned counsel for the petitioner and of the learned standing counsel representing the respondents 2 & 3. I have perused the material record.

The grievance of the writ petitioner is that the officials and staff of the respondents 2 & 3 are interfering with the petitioner's business in the petty shop situated in the subject house on the ground that he is selling pooja articles. Learned standing counsel, on instructions, submits that the officials and staff of the respondents 2 & 3 are not, in any manner, interfering with the petitioner's alleged business in the subject property and that without stating any reasons and by making bald allegations, the present writ petition is filed. Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere with the petitioner's business in the petty shop in the subject property. However, this order shall not preclude the respondents 2 & 3 from proceeding against the property of the petitioner in future, if necessary and if the facts and circumstances warrant such a course of action. There shall be no order as to costs.
