Vide present petition, the petitioner/ A.2 seeks a direction, thereby to release him on bail in Cr.No.52 of 2016 of PS Jalumuru, registered for the offences under Sections 302, 120(B), 201, 109, 212 read with 34 of IPC. Pursuant to the order dated 16.11.2016, the Medical Officer, District Jail, Srikakulam, sent a medical report of the petitioner, which is taken on record.

On perusal of the medical documents of the petitioner and the opinion of the Medical Officer, though the petitioner is suffering from diabetes mellitus with cardiac problem, however, the Jail Authorities are providing treatment to the petitioner in RIMS General Hospital, Srikakulam and Echo test was also conducted on 27.10.2016. Thus, the petitioner is getting proper treatment in the hospital.

In view of the above, I am not inclined to admit the petitioner on bail, who was arrested just 80 days before in a case registered against him and others, as the petitioner/ A.2 along with A.1 and A.3, conspired together and paid an amount of Rs.5.00 lakhs to the hired killers to eliminate the deceased.
