Mohd. Abdul Subhan v. The State Of Telananga
THE HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.41005 OF 2018
O R D E R
This writ petition was filed assailing the action of the Joint Collector, Ranga Reddy District, in not disposing of the revision petition filed by the petitioners, which was taken on file as Revision Petition No.D1/4585/2018.
By order dated 14.11.2018 passed in the writ petition, interim suspension of the proceedings dated 31.01.2014 of the Revenue Divisional Officer, Chevella Division, Ranga Reddy District, which were the subject matter of challenge in the pending revision petition, was granted and the matter was adjourned by three months to enable the Revisionary Authority to do the needful.
However, Sri P.Shiv Kumar, learned counsel for the petitioners, would inform this Court that the revision is still pending as on date. Be it noted that the respondents in the revision, viz., respondents 5 and 6 herein, were duly served, but they did not choose to enter appearance before this Court.
It is not open to a statutory Revisionary Authority to entertain and keep pending a revision filed before him indefinitely. Valuable property rights of the parties thereto would be at stake and such delay would invariably affect their interest adversely.
The writ petition is accordingly disposed of directing the Joint Collector, Ranga Reddy District, to consider on merits the petitioners' Revision Petition No.D1/4585/2018 and dispose of the same expeditiously and in any event, not later than three months from the date of receipt of
a copy of this order. Pending such disposal, the interim suspension granted on 14.11.2018 shall continue to operate. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 14th FEBRUARY, 2019 Svv
