This writ petition is filed aggrieved by the action of respondents in demanding conversion charges on the value fixed for house sites in the basic value register, in respect of petitioner's agricultural land for conversion to nonagricultural purposes under the provisions of Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 (for short 'the Act') and the Rules made thereunder.
Heard learned counsel for petitioner and the learned Assistant Government Pleader for Revenue.
Learned counsel for petitioner submits that the writ petition can be disposed of directing the petitioner to make an application under Section 3 of the Act and the same may be considered and disposed of by the 2nd respondent in terms of Section 4 r/w. Rules 3 and 4 of the Act and the Rules. In view of the same, it is open for the petitioner to make an application to the 2nd respondent and the 2nd respondent shall consider the same in terms of Section 4 r/w. Rules 3 and 4 of the Act and Rules, regarding the value to be adopted for imposing the conversion charges and pass appropriate orders within a period of Six weeks from the date of receipt of application of petitioner, by giving opportunity of hearing to the petitioner. With the above direction, the writ petition is disposed of. No order as to costs.
