HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28714 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of the respondents in recognizing the writ petitioners and other members of Penuka family as the hereditary members entitled for 33% share of the income generated during Sammakka Sarakka Jatara, as illegal and arbitrary.
2. Heard the learned counsel for the petitioners and the learned Government Pleader for Endowments (Telangana).
3. The case of the petitioners is that they belong to Pagididda Raju's family, who is the husband of Sammakka, and their surname is 'Penuka'. It is the case of the petitioners that the members of 'Penuka' family have been performing all the rituals at the time of 'Sammakka - Sarakka Jatara', since the times immemorial, by incurring personal expenses. It is further case of the petitioners that recently the Government of Telangana recognized 'Sammakka - Sarakka Jatara' as 'State' festival and has been performing Jatara under its aegis. A part of the income generated at the Jatara is being granted by the Government to the families of 'Siddaboyina' and 'Vaddelu', though they are not entitled for any share as they are not related to either 'Sammakka' or 'Sarakka'. The contention of the petitioners is that except 'Penuka' family members, no other persons including the families of 'Siddaboyina' and 'Vaddelu', are entitled for any share in the income generated during Jatara.
4. A perusal of the record reveals that the petitioners herein submitted a representation dated 11.01.2016 to the respondents claiming a share in the income generated during Jatara.
5. At the time of arguments, the only relief sought by the petitioners is to direct respondents 2 and 3 to dispose of the representation of the petitioners dated 11.01.2016. Learned Government Pleader also consented for the same.

Having regard to the facts and circumstances of the case and in view of the submissions made by the learned counsel for both the parties, respondents 2 and 3 are hereby directed to dispose of the representation of the petitioners dated 11.01.2016, within a period of two months, from the date of receipt of a copy of this order. 7 . The writ petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _____________________ T.SUNIL CHOWDARY, J August 26th, 2016.
