HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41106 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not removing the illegal constructions made by the respondents 3 and 4 abutting to plot Nos.281 and 323 respectively by encroaching into the Magunta Layout Road, adjacent to railway track, Nellore, SPSR Nellore District, by considering the representation dated 29.10.2018, as illegal and arbitrary. Learned counsel for the petitioners submits that though the petitioners submitted an application to the 2nd respondent on 29.10.2018, seeking to remove the illegal constructions made by the respondents 3 and 4, abutting to subject plots, no action has been taken so far.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent to deal with the representation dated 29.10.2018, submitted by the petitioners seeking to remove the illegal constructions made by the respondents 3 and 4 abutting to subject plots, and pass appropriate orders, in accordance with law as early as possible, preferably within a period of four to six weeks from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
