THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 34537 OF 2016 O R D E R :

This Writ Petition is filed seeking a mandamus to declare the inaction on the part of Respondents 1 to 4 on the representations of the petitioner to remove the encroachment in the nala in Padmavathi Colony in Survey No. 385 under Alwal Municipality, Malkajgiri Mandal, Ranga Reddy District, as arbitrary and illegal. The case of the petitioner is that he is a resident of H.No. 30-390, Padmavathi Nagar, Kanojiguda, Ranga Reddy District. His complaint is that the unofficial respondent had encorahced into the nala passing through the colony and made construction over it reducing its width from 3.30 to 2.60 meters. The said factum was confirmed by the Deputy Commissioner, Greater Hyderabad Municipal Corporation, Circle No.16, Alwal, Secunderabad, on an Application being made by the petitioner under the Right to Information Act.

Therefore, the petitioner had submitted representations to the officials of the Corporation on 26.07.2013 and 17.05.2013 and also complaints to the police on 13.09.2016 and 09.09.2016, but no action has been taken thereon so far. Sri Chatla Madhu, learned Standing Counsel for Greater Hyderabad Municipal Corporation submits that the representations of the petitioner would be attended to and necessary action would be taken thereon, in accordance with law. In that view of the matter, without expressing any opinion on the merits of the matter, the 2nd respondent is directed to take

necessary action on the representations submitted by the petitioner, after giving notice to the 5th respondent, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
