THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6984 OF 2016 ORDER:

This Criminal Petition is filed by the petitioner/appellant seeking to quash the order, dated 8.3.2016, in Crl.M.P.No.171 of 2015 in Crl.R.P.No.24 of 2015 on the file of the I Additional District and Sessions Judge, Srikakulam District.

2. Respondent No.2 is the wife of the petitioner. She filed M.C.No.26 of 2012 before the Special Judicial Magistrate of I Class, Prohibition and Excise Court, Srikakulam seeking maintenance at Rs.7,000/- per month and the same was partly allowed granting maintenance at Rs.4,000/- per month. Challenging the same, the petitioner herein filed Crl.R.P.No.24 of 2015 on the file of the District Judge, Srikakulam.

He also filed Crl.M.P.No.171 of 2015 to stay all the proceedings in the M.C. and the same was dismissed.

Challenging the same, he filed the present Criminal Petition.

3. Heard and perused the material available on record.

4. Having regard to the facts and circumstances of the case, this Court is not inclined to pass any order as prayed for by the petitioner.

5. Accordingly, the Criminal Petition is dismissed. As the case relates to granting of maintenance, the appellate Court is directed to dispose of Crl.R.P.No.24 of 2015 as early as possible, preferably, within a period of three (3) months from the date of receipt of a copy of this

order.

6. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
