THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CIVIL MISCELLANEOUS PETITION NO.727 OF 2018 ORDER:

This transfer civil miscellaneous petition is filed under Section 24 of Civil Procedure Code (for short "C.P.C.") to withdraw O.P.No.1352 of 2017 from the file of the Judge, Additional Family Court, City Civil Court, Hyderabad, and transfer the same to the Court of Judge, Family Court, City Civil Court, Hyderabad or any other competent Court on the ground that the petitioner complained against the Presiding Officer of the Court to the Chief Judge, City Civil Court, Hyderabad about the way in which he dealt with the matter, thereafter she appeared before the Court and on the same day, an order granting interim custody was passed without hearing the objections raised by the petitioner herein, therefore, she is suspecting the bonafides of the officer.

In view of the allegations made against the Presiding Officer of the Court, instead of ordering notice, waiting for some more time, it is appropriate to withdraw O.P.No.1352 of 2017 from the file of the Judge, Additional Family Court, City Civil Court, Hyderabad, and transfer the same to the Court of Judge, Family Court, City Civil Court, Hyderabad. Accordingly, O.P.No.1352 of 2017 is withdrawn from the file of Judge, Additional Family Court, City Civil Court, Hyderabad, and transferred the same to the Court of Judge, Family Court, City Civil Court, Hyderabad.

In the result, the transfer civil miscellaneous petition is allowed. Consequently, miscellaneous applications pending if any, shall stand closed. No costs.
