HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41043 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the inaction of the 1st respondent in not considering the stay petition or revision filed by the petitioner against the order of the 2nd respondent in Proceedings No.11638/R3-2/2016, dated 31.1.2017, rejecting the application of the petitioner without notice in respect of Quarry lease application for Colour Granite over an extent of 5.00 Ha in Sy.No.103 of Konidena Village, Ballikurava Mandal, Prakasam District as illegal and arbitrary.

Learned counsel for the petitioner submits that though the petitioner filed the stay petition along with the revision before the 1st respondent against the order of the 2nd respondent in Proceedings No.11638/R3-2/2016, dated 31.1.2017, rejecting the application of the petitioner without notice in respect of Quarry lease application for Colour Granite over an extent of 5.00 Ha in Sy.No.103 of Konidena Village, Ballikurava Mandal, Prakasam District, the 1st respondent did not pass any orders either in the stay petition or in the revision, so far. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 1st respondent, to deal with the stay petition or revision filed by the petitioner as the case may be and pass appropriate orders, as early as possible preferably, within a period of four weeks from the date of receipt of copy of this order, in accordance with law, after giving the reasonable opportunity of hearing to the petitioner and all concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
