THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34757 of 2017 ORDER:
The petitioner claims to be the owner of Lorry bearing No.AP 37 W 9557. When it was involved in transporting the rice without invoice and way bills, it was seized on 16.09.2017. The petitioner filed a petition before the second respondent for release of the vehicle. When no orders are passed by the second respondent, the present Writ Petition is filed. It is apparent from the record that the vehicle was seized one month back and the continuous detention of the vehicle is not in the interest of the respondents or the petitioner. The vehicle can be ordered to be released on the petitioner furnishing a bank guarantee for a sum of Rs.2,00,000/- (Rupees two lakhs only) and with an undertaking that he shall not alienate and insure the vehicle during the pendency of the petition before the second respondent.
In the circumstances, this Writ Petition is disposed of directing the third respondent to release the vehicle pending disposal of the appeal before the second respondent on the petitioner furnishing a bank guarantee for a sum of Rs.2,00,000/- (Rupees two lakhs only) and furnishing an undertaking that he shall not alienate the vehicle and produce the same as and when demanded by the third respondent and also insure the vehicle against any damage or accident. The
