THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35279 of 2017 ORDER:

The petitioner claims to be the owner of a lorry bearing No.AP 16 TV 5549, which is run by her son-in-law who is a driver by profession. On the intervening night of 15th and 16th of September, 2017, when the vehicle was transporting rice from Recherla Village in Chinthalapudi Mandal to Denduluru Village and Mandal, it was intercepted by the fourth respondent, a crime was registered under Section 7 of the Essential Commodities Act read with Sections 420 and 468 of IPC and the vehicle along with the stock was seized and handed over to the third respondent for taking steps under Section 6A of the Essential Commodities Act. The petitioner submitted a petition on 30.09.2017 seeking interim custody of the vehicle and expressed readiness to furnish the third party security. When no orders were passed by the second respondent, the present Writ Petition is filed.

Since the petition filed by the petitioner seeking release of the vehicle is pending before the second respondent, this Writ Petition is disposed of directing the second respondent to consider the same and pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 24.10.2017 vs
