THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35155 of 2017 ORDER:

The petitioner states that he is the Proprietor of Sri Sai Krishna Oil Traders. He is dealing with food grains and edible oils under licence issued by the authorities, which is valid up to 30.09.2017. While so on 14.09.2017 the third respondent inspected the shop and seized the stock on the allegation that he was not maintaining the stock register. The third respondent submitted a report to the second respondent. The petitioner submitted an application on 21.09.2017 for release of the stock and the second respondent passed an order on 06.10.2017 directing the petitioner to furnish the bank guarantee for an amount of Rs.2,81,902/- for release of the seized stock. Challenging the seizure of the stock, the present Writ Petition is filed.

The petitioner states that he is not in a position to furnish the said bank guarantee, but agrees to cooperate with the disposal of the proceedings before the second respondent. In the circumstances, the second respondent is directed to take up the enquiry and complete the same within a period of three months from the date of receipt of a copy of this order, and since the seized stock is not a perishable commodity, the said stock shall not be sold pending final orders to be passed by him.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 24.10.2017 Note: Issue C.C in one week.
