HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.45661 of 2016

ORDER

Heard learned counsel appearing for the petitioners, learned Government Pleader for Home appearing for respondents 1 and 2 and Sri M.Salmon Raju, learned counsel appearing for respondent No.3. This writ petition is filed challenging the action of the 2nd respondent in registering Cr.No.243 of 2016 on 20.11.2016 for the offences punishable under Sections 498-A, 324 read with 34 IPC and Section 3 (1) ( r ) (s) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 2015, against the petitioners based on the complaint lodged by the de facto complainant. A perusal of the complaint lodged by the 3rd respondent and the averments made therein constitute a prima facie case for registration of the crime.

In view of the same, this Court is not inclined to interfere with registration of crime. However, the respondent-police are directed to follow due process of law while investigating the crime. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 14th March, 2017 rkk
