This writ petition is filed challenging the impugned order passed by the respondents suspending the authorisation of the petitioner.
Learned counsel for the petitioner submits that in view of the Judgment rendered by this Court in WP.No.35382 of 2015 dated 10.11.2015, the authorities cannot keep the authorisation of the petitioner under suspension beyond 90 days; and that the writ appeal filed against the said writ petition is also dismissed.
Learned Government Pleader for Civil Supplies could not dispute the same, but, however, produced written instructions dated 24.10.2017 stating that enquiry is proposed on 04.11.2017 and necessary orders will be passed. Following the Judgment in WP.No.35382/2015 dated 10.11.2015, the impugned order is set aside. However, this will not preclude the respondent authorities from passing final orders in the enquiry initiated against the petitioner. The petitioner shall cooperate with the enquiry. If he does not, it is open for the respondent authorities to pass appropriate orders, in accordance with law.
Accordingly, the writ petition is allowed. No order as to costs.
