THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.34794 AND 34796 OF 2017 COMMON ORDER:

These two writ petitions are being disposed of by this common order as they relate to challenge to the same notification dated 05.10.2017 calling for applications for appointment of permanent fair price shop dealers in respect of Shop Nos.27 and 33 of Jowkula Village, Amadagur Mandal, Ananthapuramu District.

The petitioners in the writ petitions are temporary dealers and now the second respondent issued the Notification reserving shop No.27 for the Scheduled Caste (General) and shop No.33 for Scheduled Tribe (General). The learned counsel for the petitioners pointed out that the reservation was not done properly as per the Register of Roster. The learned Government Pleader was directed to produce the Register of Roster and he produced the same. As per the Register of Roster, the said two shops were reserved for the communities mentioned in the Notification.

In view of the satisfaction of this Court with regard to the reservation, this Court sees no ground to interfere with the said reservation. But, the learned counsel for the petitioners submits that overall reservation is not properly maintained and this Court has to enquire with regard to the maintenance of percentage of reservation for different communities. The material is not produced by the learned counsel for the petitioners. It is for the petitioners to get entire information from the Revenue Divisional Officer and it is open to the petitioners to file a comprehensive writ petition challenging the reservations, if any. So far as the present cases are concerned, they are relating to the Notification issued for appointment of permanent fair price shop dealers in respect of the above mentioned two shops and as this Court is satisfied with regard

to the reservation indicated in the Notification when compared with the Register of Roster. This Court sees no ground to interfere with the impugned orders.

The writ petitions are accordingly dismissed. Consequently, miscellaneous petitions, if any pending, in these writ petitions shall stand closed. There shall be no order as to costs.
