The grievance of the petitioner is that she filed revision petition along with stay petition before the 2nd respondent on 09.11.2017 against the proceedings in Rc.CS2/01/2017, dated 22.10.2017, wherein the Collector (CS) disputes the certificates filed by the petitioners. As no orders passed on the revision filed by the petitioner, present writ petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies.
Learned counsel for the petitioner submits that petitioner was appointed on compassionate grounds and at the time of initial appointment, no qualifications are required, but the petitioner has to acquire the same within a period of three years, but the petitioner's dealership was cancelled on 17.12.2016. He submits that the petitioner has never produced fake Transfer Certificate and that aspect as not considered by the appellate authority. On the other hand, learned Assistant government Pleader for Civil Supplies submits that the appellate authority has considered the aspect of producing fake Transfer Certificate by the petitioner and came to the conclusion that the petitioner filed fake Transfer Certificate and Headaster also certifies the same. It is to be seen that the Revision along with Stay petition is pending before the 2nd respondent and petitioner was continued as dealer of subject Fair Price Shop, pending appeal, by virtue of orders passed by this Court in WP No.2329 of 2017 dated 24.01.2017.
In view of the same, when statutory Revision is pending before the 2nd respondent, this Court is not inclined to go into the merits of the case. As such, 2nd respondent is directed to dispose of the revision filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. Till then, the impugned proceedings Rc.CS2/01/2017, dated 22.10.2017 passed by the 3rd respondent remain suspended.
With the above direction, writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 21-11-2017 kvs
