This writ petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in issuing Notification in Rc.No.5126/2017-B, dated 18.10.2017, without deciding the application of the petitioner for appointment of FP Shop dealership No.14 of Tadikonda Village and Mandal, Guntur District, as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies. It is the case of the petitioner that he made representation to the 2nd respondent for compassionate appointment in terms of G.O.Ms.No.4, dated 28.02.2014 for appointment him as Fair Price Shop dealer. In pursuant to the same, the 2nd respondent called for report from the 3rd respondent, but no orders are passed. In the meanwhile, impugned Notification dated 18.10.2017 was issued for filling up of the post of fair price dealers including the fair price shop in respect of which the petitioner is claiming under compassionate appointment.

Learned Assistant Government Pleader for Civil Supplies submits that the petitioner was issued notice dated 24.10.2017 and that within two weeks, orders would be passed.

In view of the same, the 2nd respondent is directed to dispose of the representation of the petitioner in terms of G.O.Ms.No.4, dated 28.02.2014 within a period of two weeks from the date of receipt of a copy of this order. Till the disposal of the aforesaid representation, the respondents shall not make permanent appointment in respect of Fair Price Shop No.14, Thadikonda Village & Mandal, Guntur District. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
