The petitioner states that he is doing kirana business and also dealing with edible oils. While so on 14.09.2017 the third respondent inspected the shop and seized the stock on the allegation that he was not having valid licence. On the basis of the report submitted by the third respondent, proceedings under Section 6A of the Essential Commodities Act were taken up by the second respondent. The petitioner submitted an application on 21.09.2017 for release of the stock and the second respondent passed an order on 06.10.2017 directing the petitioner to furnish the bank guarantee for an amount of Rs.1,51,973/- for release of the seized stock. Challenging the seizure of the stock, the present Writ Petition is filed.

The petitioner states that he is not in a position to furnish the said bank guarantee, but agrees to cooperate with the disposal of the proceedings before the second respondent. In the circumstances, the second respondent is directed to take up the enquiry and complete the same within a period of three months from the date of receipt of a copy of this order, and since the seized stock is not a perishable commodity, the said stock shall not be sold pending final orders to be passed by him.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 24.10.2017 Note: Issue C.C in one week.
