O R D E R

Aggrieved by the inaction of the 4th respondent - Sub Collector, Madanapalle, Chitoor District, in considering the representations of the petitioner, the latest being 23.10.2017, for appointing him as dealer for fair price shop No.35, Kandur village, Chitoor District on compassionate grounds in the place of his deceased mother, who was the dealer for the said shop, as per guidelines under G.O.Ms.No.4 Consumer Affairs, Food and Civil Supplies (CS-I) Department dated 28.02.2014;

and in issuing notification bearing Roc.No.A3/164/Somala/35/2017 dated 6.5.2017 for the said fair price shop, the present writ petition is filed.

Heard the learned counsel for the petitioner. The learned Assistant Government Pleader for Civil Supplies, on instructions, would submit that the matter is pending with the 4th respondent - Sub-Collector and he called for a further report from the 5th respondent - Tahsildar and that after receipt of report from the 5th respondent, necessary orders will be passed on the claim of the petitioner. In view of the fact that the representation of the petitioner is pending before the 4th respondent, the said authority is directed to take action on the said representation based on the report of the 5th respondent. Till the disposal of such representation by the 4th respondent, respondents are directed not to make appointment of dealer in respect of fair price shop No.35 of Kandur village, Chitoor District, on permanent basis. With the above direction, the writ petition is disposed of. No costs.
