Smt. Mukku Satyavathi , v. .State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39463 OF 2017 ORDER:
The case of the petitioner is that even though the authorization of the petitioner is valid and subsisting, the respondent-authorities are not supplying the stocks to the petitioner. Aggrieved by the same, the present writ petition is filed.
Learned Assistant Government Pleader for Civil Supplies submits that inspection was done on 14-10-2017 and the petitioner was issued a show-cause notice dated 04-11-2017 asking as to why disciplinary action should not initiated against the petitioner and without passing any order, the petitioner approached this Court.
It is to be seen that as on today the authorization of petitioner's fair price shop is valid and subsisting, the respondent-authorities cannot stop supply of stocks to the petitioner.
In view of the same, the respondents are directed to release the stocks to the petitioner as long as his authorization for fair price shop is valid and subsisting. However, this order will not preclude the respondent-authorities from passing appropriate orders in pursuance to the show-cause notice dated 04-11-2017 after considering the explanation of the petitioner if any.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 22-11-2017 Note:
