HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37057 OF 2017 O R D E R :

The case of the petitioner is that his fair price shop authorisation was cancelled by the 4th respondent vide proceedings in ROC No.1297/2017/A/CS, dated 01.04.2017 and against the same he preferred appeal before the Joint Collector-3rd respondent on 26.04.2017. As the same is not being disposed of till date, present writ petition is filed.

Learned Assistant Government Pleader for Civil Supplies submits that since petitioner is elected and continuing as 'Sarpanch', he cannot be continued as fair price shop dealer. In view of the same, it is for the 3rd respondent appellate authority to consider the said aspect and pass orders in the appeal. Having regard to the aforesaid facts and circumstances, without expressing any opinion on merits, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. N order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
