HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37122 OF 2017 O R D E R :
The case of the petitioner is that his authorisation as fair price shop dealer for Shop No.27 of V.Rajupalem Village, Chapadu Mandal, YSR Kadapa District, was cancelled by the 3rd respondent vide proceedings Reference No.B/4777/2014, dated 20.01.2015 and that challenging the said proceedings the petitioner preferred appeal before the 2nd respondent. Meanwhile, the 3rd respondent issued impugned notification dated 20.10.2017 for making appointments to shop No.27 for which petitioner's authorisation is cancelled. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Civil Supplies submits that the order cancelling the authorisation of the petitioner was passed on 20.01.2015, and against the same the petitioner preferred appeal in the year 2017 i.e. beyond the period of limitation with enormous delay and that the present notification is issued as per the Circular issued by the Director of Civil Supplies.
Having regard to the aforesaid facts and circumstances, without expressing any opinion on merits, the writ petition is disposed of directing the appellate authority to dispose of the
appeal filed by the petitioner, in accordance with law. It goes without saying that the impugned notification will always be subject to orders passed in the appeal. No order as to costs.
