THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35777 of 2017 ORDER:

The petitioner is a member of Vijayalakshmi Mahila Group and a permanent resident of Garapadu Village, Pedakurapadu Mandal, Guntur District. She owns the land of an extent of Ac.1.75 cents in the said Village. She studied up to 9th class. Since certain irregularities were committed by the regular dealer of the fair price shop in the said Village, the petitioner from her DWCRA group was appointed as a temporary dealer by proceedings dated 28.10.2004. By virtue of the temporary arrangement, the petitioner has been continuing since then. When a notification was issued on 11.10.2017 for filling up of the post of fair price shop dealer of Garapadu Village on permanent basis and the last date for submission of applications was 23.10.2017, the petitioner filed the present Writ Petition challenging the said notification.

Learned Counsel for the petitioner submits that the petitioner has been continuing for more than 13 years and though she did not fulfill the educational qualifications, she submitted an application on 11.10.2017. She also states that the authorities are going to reject her application and allot the said fair price shop to some other person.

It is clear from the above averments that the notification prescribed the pass in 10th class as a required qualification,

whereas the petitioner studied up to 9th class. The present Writ Petition is filed only on the ground that she was continuing as a temporary dealer for the last 13 years. The petitioner could not point out any law or rule enabling the petitioner to apply or restrain the respondents from issuing the notification for appointment of a permanent dealer. The petitioner is only a temporary dealer and the notification is issued for appointment of a dealer on permanent basis.

In the circumstances, this Court seeks no ground to entertain the present Writ Petition and the same is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
