THE HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL REVISION CASE NO.3122 OF 2018 ORDER:

This revision arises out of order, dated 08.10.2018 in Crl.M.P.No.4426 of 2018 (Cr.No.121 of 2018 of P & ES Uppal), on the file of the Metropolitan Sessions Judge, Cyberabad-cum-I Addl. District Judge, Ranga Reddy. 2.

Heard the learned counsel for the petitioner-A1, learned Public Prosecutor representing the State and perused the material available on record.

The petitioner filed Crl.M.P.No.4426 of 2018 for grant of interim custody of TATA India Car No. TS 13 UA 9266 and Samsung Mobile Phone in his favour. The trial Court allowed the petition and directed return of the property by imposing 9 conditions as mentioned in para 6 of the order. The petitioner challenged condition No.1 that the petitioner shall execute a bond for Rs.5,00,000/- with one surety in a like sum.

Learned counsel for the petitioner submits that the car is of 2012 model and it would not fetch more than Rs.80,000/-, if it is sold and the execution of bond for Rs.5,00,000/- with one surety imposed by the trial Court is highly excessive and therefore, sought for relaxation of the condition.

Considering the submissions made by the learned counsel for the petitioner and the learned Public Prosecutor, the order passed by the trial Court directing the petitioner to execute a bond for Rs.5,00,000/- with one surety in a like sum is relaxed. The petitioner is directed to execute a bond for a sum of Rs.1,50,000/- with one surety in a like sum to

the satisfaction of the trial Court within 10 days from the date of this order. The trial Court on such execution of bond, shall release the vehicle and Samsung Mobile phone in favour of the petitioner. However, the rest of the conditions i.e., condition Nos. 2 to 9 imposed by the trial Court shall be intact.

With the above observation, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any pending in this revision shall stand closed.
