This writ petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in issuing proceedings No.Rc.M.2027/2016, dated 10.01.2017, canceling the petitioner's authorization of Fair Price Shop No.9 of Soganur Village, Yemmiganur Mandal, Kurnool District, without recording proper reasons and affording opportunity of hearing to the petitioner, as illegal and arbitrary.
Heard both sides.
Admittedly, petitioner has alternative remedy against the impugned order and he can raise all his objections before the appellate authority. As such, this Court is not inclined to entertain the writ petition.
Accordingly, the writ petition is disposed of granting liberty to the petitioner to file appeal against the impugned order and on such appeal being filed by the petitioner, the appellate authority shall consider the objections raised by the petitioner and pass orders in accordance with law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
