THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.1867 of 2016 ORDER:

In this Writ Petition, the petitioner has questioned the proceedings dt.19-01-2016 of the 3rd respondent suspending petitioner's fair price shop dealership authorization.

2. A show cause notice dt.19-01-2016 has also been issued to petitioner by 3rd respondent setting out the irregularities noticed in the inspection of the petitioner's fair price shop on 12-01-2016.

Although learned counsel for petitioner seeks to contend that the allegations made in the show cause notice are not correct, this is a matter for enquiry which has to be conducted as per sub-Clause (5) of Clause(5) of the A.P. State Public Distribution System (Control) Order, 2008.

4. Therefore liberty is granted to petitioner to submit an explanation to the show cause notice dt.19-01-2006 within two (02) weeks from today and the 3rd respondent is directed to conduct enquiry as per the above provision of

law giving personal hearing to petitioner and take a decision in the matter on or before 30-04-2016. 5.

The Writ Petition is disposed of with the above direction. No costs.

6. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
