This petition is filed for a writ of Mandamus declaring the action of the 4th the respondent in not allotting the essential commodities to the petitioner's shop No.49, Reddynaik Tanda, H/o.Budawada Village, Jaggaiahpeta Mandal, Krishna District, as illegal and arbitrary. Learned counsel for the petitioner submits that though petitioner's fair price shop authorization is valid and subsisting, the respondent authorities are not supplying the stocks to the petitioner for distribution to the card holders.

Learned Government Pleader for Civil Supplies submits that respondent authorities inspected the petitioner's shop and seized the stocks on the ground of irregularities; and that proceedings are initiated against the petitioner under Section 6 A of the Essential Commodities Act, which is pending.

It is to be seen that as long as petitioner's authorization is valid and subsisting respondents cannot stop supplies to the petitioner. In view of the same the writ petition is disposed of directing the respondents to supply stocks to the petitioner as long as petitioner's authorization is subsisting and valid. However, this order will not preclude the respondents from taking action against the petitioner, in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
