The case of the petitioner is that her husband by name Venkateswara Rao, who was a permanent Fair Price Shop dealer passed away on 10-04-2012 leaving the petitioner and their two children.

Thereafter, the petitioner made applications on 25-08-2014 and 06-04-2015 for considering her case for appointment of Fair Price Shop dealer on compassionate grounds. Without considering the applications of the petitioner, the respondents have issued notification for appointment of fair price shop dealer to the fair price shop No.523011. Aggrieved by the same, the present writ petition is filed.

Learned Assistant Government Pleader for Civil Supplies submits that the petitioner has not produced any certificates with regard to educational qualifications. But in the application dated 06-04-2015 filed in the material papers, it is shown that the petitioner has produced Transfer Certificate showing that she has studied 7th class.

In view of the same, there shall be direction to the 2nd respondent to consider the applications dated 25-08-2014 and 06-04-2015 filed by the petitioner in terms of G.O.Ms.No.4, dated 28-02-2014 and pass orders accordingly. Till such time, the respondents shall not make permanent appointments of dealer to the Fair Price Shop No.523011.

It is open for the petitioner to submit further documents if necessary.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________ A.RAJASHEKER REDDY,J 14-11-2017 Note:
