HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37467 of 2017 ORDER :

The case of the petitioner is that his Fair Price Shop Authorisation was cancelled by the 3rd respondent vide proceedings in Rc.C.2450/2013, dated 08.03.2014 and against the same petitioner filed appeal before the 2nd respondent and the same was disposed of by the 2nd respondent vide order dated 13.08.2014 remanding the matter to the Disciplinary Authority i.e. the Revenue Divisional Officer, Gudur with a direction to finalise the disciplinary proceedings within 2 weeks. But, as on today, no orders are passed. Aggrieved by the same present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Civil Supplies submits that petitioner is not cooperating in the matter, as such, delay occurred. He also produced written instructions dated 08.11.2017 wherein it is stated that notice has been issued to the petitioner and the case is posted to 18.11.2017 and that the matter will be finalized soon after enquiry is completed.

In view of the same, the writ petition is disposed of directing the 3rd respondent to pass appropriate orders in

pursuance to the remand order dated 13.08.2014, after affording an opportunity of hearing to the petitioner, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.
