HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.37732 OF 2017 ORDER:

The petitioner is challenging the impugned notification on the ground that though minimum qualifications prescribed for the post of a fair price shop dealer is 7th class as per G.O.Ms.No.4, dated 19-02-2011, but in the impugned notification it is indicated as 5th class and it is also challenged on the ground that the petitioner is shown as resigned for the shop No.8, which is disputed by learned counsel for the petitioner.

Now learned Assistant Government Pleader for Civil Supplies produced addendum notification dated 09-11-2017 showing 7th class as minimum qualification. He also says that the petitioner is a temporary fair price shop dealer and she has no right to challenge the notification issued for making appointments on permanent basis.

In view of the same, I do not see any reason to interdict the notification. However, it is open for the petitioner to apply in pursuance to such notification, if she is otherwise qualified and eligible.

Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
