HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 37763 of 2017 ORDER :

Heard learned counsel for the petitioners and learned Government Pleader for Civil Supplies.

This writ petition is filed challenging the impugned notification in Rc.No.5309/2017-B, dated 30.10.2017 only on the ground that the qualification for fair price shop dealer is mentioned as 5th class though G.O.Ms.No.4, dated 19.02.2011 provides that minimum qualification is 7th class. Learned counsel for the petitioners submits that the petitioners are functioning as temporary fair price shop dealers. He also submits that the in the impugned notification it is mentioned that the fair price shop dealers have resigned and also that the impugned notification was also communicated to the Members of Legislative Assembly. Learned Government Pleader for Civil Supplies produced written instructions stating that errata notification is being published and the minimum qualification is mentioned as 7th class. He submits that as the original dealers have resigned, the same is being mentioned in the notification.

The communication of the impugned notification to the Members of Legislative Assembly cannot be a ground for quashing the impugned notification.

In view of the same, I do not see any merit in the writ petition and accordingly, the same is dismissed. However, if the petitioners are qualified, they can also make application in pursuant to the impugned notification.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
