The present writ petition came to be filed seeking to declare the action of the 3rd respondent in issuing the notice dated 29.9.2018, directing the petitioner to vacate the shop admeasuring 17.05 sq. mts, situated at S.No.467/1 and 467/A, on the bank of Commercial Cannal, Kakinada Port, without following due process of law, as illegal and arbitrary.
When the matter is taken up for hearing, the learned Government Pleader for Industries and Commerce, would submit that there is no representation made by the petitioner after issuing the impugned notice and the petitioner may be directed to submit an application to the 2nd respondent putting forth his grievance along with necessary documentary proof, in which event, the 2nd respondent shall pass appropriate orders in accordance with law. Having regard to the above, the writ petition is disposed of directing the petitioner to submit an application to the 2nd respondent putting forth his grievance along with necessary documentary proof, in which event, the 2nd respondent shall pass appropriate orders, as early as possible, in accordance with law, after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
