THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.36353 of 2017 ORDER:

Heard Mr K.L.N.Swamy, counsel for petitioner and Assistant Government Pleader (Home) for respondents. The writ prayer is in two limbs.

(a) declaring the inaction of respondents 2 to 5 in taking action on the complaints dated 18.09.2017 and 16.10.2017.

(b) to direct the respondents to provide necessary protection to petitioners life and property.

The first prayer refers to inaction and the 2nd prayer in not giving police protection to petitioners.

The Assistant Government Pleader in respect of the first limb of the writ prayer, places on record the written instructions dated 03.11.2017 and submits that police have registered a case in Crime No.203 of 2017 dated 26.09.2017. On the other limb of the writ prayer, she submits that if a representation is made to respondent Nos.4 and 5, the same would be considered depending upon the perception and appropriate decision is taken in this behalf. Hence, I am satisfied the writ petition can be disposed of by this order.

The petitioner is given liberty to submit the representation, for police protection by enclosing a copy of this order within two (02) weeks from today. The respondent Nos.4 and 5 shall consider the representation and take a decision within four (04) weeks thereafter. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
