2018-11-26A.Rajasheker Reddy1 pages

THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.41057 OF 2018

O R D E R

The case of the petitioner is that he is the pattadar and possessor of the land in an extent of Acs.7.35 guntas in Sy.No.134, Thimmareddipally village of Kondapak Mandal, Siddipet District. For ingress and egress to his land, road is existing in the Government land in Sy.No.140 in Inapur village of Komuravally mandal, Siddipet District, for the last more than thirty years. The petitioner alleges that the respondents in collusion with some of the villagers, are trying to disturb the said road, thus making entry to his land inaccessible. Therefore, he made representations and the latest one was on 11.10.2018. As respondents have not considered the same, the present writ petition is filed.

Learned Assistant Government Pleader for Revenue, on instructions, while denying the allegation of the petitioner, submits that no road is in existence in the Government land, as averred by the petitioner. Learned counsel for the petitioner, while disputing the above submission, sought to produce the copy of village map, to show the existence of the road in Government land referred to above. These aspects have to be considered by the 3rd respondent - Revenue Divisional Officer.

In view the same, writ petition is disposed of directing the 3rd respondent to dispose of the representation of the petitioner stated to have been made on 11.10.2018, and take action in accordance with law. Interlocutory applications pending, if any, shall stand closed. No costs. ---------------------------------------- A.RAJASHEKER REDDY,J DATE:26-11-2018 AVS
