HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION NO.36229/2017 ORDER:

The Petitioners challenge order passed under Section 145 of Criminal Procedure Code in M.C.No. 05/2016 'B' dt. 30.04.2016, U/S 145 Cr.P.C.. Mr. Srinivas Ambati submits that the petitioners are satisfied if they are given liberty to represent 3rd respondent for re-examining the issue and passing orders as are deemed fit and proper in the circumstances of the case. The Assistant Government Pleaders (Revenue & Home) did not object to the alternate submission. Keeping in view the limited prayer canvassed before the Court, the Writ Petition is disposed of by this order : (a) The petitioners are given liberty to submit explanation to 3rd respondent within four weeks from today by enclosing a copy of this order.

(b) The 3rd respondent is directed to look into the explanation offered to rival claims and pass orders as expeditiously as possible, preferably within two months from the date of receipt of explanation.
