Heard Mr.B.Sasanka, counsel for petitioner and Assistant Government Pleader (Home) for respondents 1 to 5. No representation for 6th respondent.
The Petitioner has twin grievances against respondents 4 and 5. The first grievance is that respondent Nos. 4 and 5, at the instance of 6th respondent are interfering in civil dispute. Secondly, respondents 4 and 5 are facilitating disobedience of Ad-Interim injunction granted by the Court of a competent jurisdiction. Hence the Writ Petition. On 20.10.2017, this Court ordered notice to the respondents 5 and
6. The Assistant Government Pleader (Home) was also directed to get instructions.
The Assistant Government Pleader on instructions submits that on the complaint filed by the 6th respondent, Crime No.100/2017 under Section 147, 452, 427, 324, 506 r/2 149 IPC was registered. The respondents except registering the crime and investigating as mandated by criminal procedure code have not interfered in civil disputes. The Writ Petition is disposed of by placing on record the statement viz. that respondents 4 and 5 are not interfering in the civil disputes but are investigating crime No. 100/2017. It is made clear that the investigation in Crime No. 100/2017 is in accordance with law. In the process of investigation neither civil disputes are entertained nor any party to civil dispute is encouraged to disobey Court Order.
The Writ Petition is disposed of as indicated above. Miscellaneous Applications, if any, shall stand closed.
