HON'BLE SRI JUSTICE S.V. BHATT W.P. No.34790 OF 2017 ORDER:

Heard Mr.T.Balaji for petitioners and the Assistant Government Pleader (Home) for respondents.

The petitioners pray for following relief:

" ...Writ Order or direction, preferably one in the nature of WRIT OF MANDAMUS, declaring the action of the Respondents 2 and 3 in frequently calling the petitioners to the 3rd respondent Police Station by sitting hours together to settle the civil dispute regarding recover of money is illegal, arbitrary and violation of Articles, 16 and 21 of the Constitution of India and consequently direct the respondents not to interfere with the petitioner's personal liberty and the dispute civil in nature..."

The Assistant Government Pleader on instructions from respondents submits that as on date, FIR is not registered against petitioners or wanted for investigation by the Police. Therefore, the allegation that the petitioners are summoned to police station is denied. Further, the respondents as and when necessary to call petitioners to police station, will call the petitioners if a crime is registered and the petitioners are required for investigation in accordance with law.

The statement of Assistant Government Pleader is placed on record and the writ petition is disposed of accordingly. No order as to costs.
