THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35811 of 2017 ORDER:

The petitioner prays for the following relief :- " .... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondent Nos. 2 and 3 in not registering FIR on the complaints made by the Petitioner dated 14-10-2017, 15-10-2017 and 18-10-2017 as illegal, arbitrary and violation of Articles 14 and 21 of Constitution of India and consequently direct the Respondent Nos. 2 and 3 to register the FIR on the complaints made by the Petitioner dated 14-10-2017, 15-10-2017 and 18-10-2017...."

The Assistant Government Pleader, on instructions, submits that the preliminary investigation is undertaken and the prayer is premature.

The petitioner made complaints on 14.10.2017, 15.10.2017 and 18.10.2017. According to the instructions, the complaint is investigated.

Therefore, if there is delay in conduc ting investigation or the petitioner sees injustice in the manner of conducting investigation, it is open to petitioner to approach this Court, however, with correct cause of action and details. At this stage, with the details stated in the affidavit, this Court does not

want to exercise its jurisdiction. Hence, the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
