HON'BLE SRI JUSTICE S.V.BHATT W.P.No.37157 OF 2017 ORDER:

The petitioner prays for the following relief: "...this Hon'ble Court may be pleased to issue writ or direction particularly in the nature of mandamus or any other appropriate writ, A). To declare the action of the respondents in interfering with the personal liberty and privacy of the petitioner by calling the petitioner and his family members to the police station under the guise of the alleged complaint lodged by the 4th respondent as illegal, void, arbitrary and violating the fundamental rights guaranteed under Article 14, 19 and 21 of the Constitution of India. B) Consequently to direct the respondents not to interfere with the personal liberty and privacy of the petitioner by calling the petitioner and his family members to the police station under the guise of the alleged complaint lodged by the 4th respondent and pass....."

The grievance of the petitioner is that the respondents are interfering in civil dispute.

Having regard to the facts and circumstances of the case, the writ petition is dismissed by granting liberty to the petitioner to file a comprehensive suit against the private parties who are interfering with petitioner and also the officers against whom allegations are made that they are acting as agents of such private parties and facilitating compromise or interfering with petitioner's liberty. Since such actions, if are true or not in connection with continuation of investigation of a crime, the officers will be doing such acts at their cost and expense.

The writ petition is, accordingly, dismissed. There shall no order as to costs.
