I.A.No.1 of 2025 For the reasons stated in the affidavit filed in support of the application, delay of 33 days in filing the review petition is condoned.

Accordingly, the application is ordered.

I.A.No.2 of 2025 This application is filed seeking to review the judgment, dated 03.09.2024, rendered by this Court in W.A.No.597 of 2016.

Heard. Perused the record.

Learned Standing Counsel appearing for the review petitioners-Bharat Dynamics Limited had contended that the judgment, dated 03.09.2024, was rendered on merits and this Court was pleased to set aside the punishment imposed on the respondent. Therefore, the undertaking given by the review petitioners with regard to modifying the punishment imposed on the respondent recorded in the judgment, dated 03.09.2024, may be deleted. Having regard to the reasons stated in the affidavit filed in support of the application and the submissions made, the undertaking of the review petitioners recorded at paragraph No.6 of the judgment, dated 03.09.2024, i.e. "Learned Standing Counsel, on instructions, had informed this Court that the respondents are willing to modify the punishment of withholding of two increments with cumulative effect to that of without cumulative effect.", stands deleted.

Accordingly, the review petition is ordered.

Registry is directed to issue corrected copy of the judgment, dated 03.09.2024, to the parties.
