Heard Ms G.Padmaja, counsel for the petitioner and the Assistant Government Pleader for Home.
The defacto complainant in C.C.No.26 of 2007 on the file of VI Additional Judicial Magistrate of First Class, Guntur is the writ petitioner.
The petitioner complains against inaction of 2nd respondent in completion of the prosecution expeditiously, as illegal.
The Assistant Government Pleader basing on written instructions of even date states that, the stay granted by this Court in a quash petition was vacated as recently as on 23.10.2017 and the interim order, having regard to the number of witnesses to be examined etc., and also keeping in view, the age of petitioner would expedite the prosecution by taking all necessary steps before the VI Additional Judicial Magistrate of First Class. He further states that the petitioner as and when required, ought to cooperate for completing the prosecution. The statement of Investigating Officer is placed on record. Writ petition is disposed of directing 2nd respondent to expeditiously complete prosecution preferably within three (03) months from the date of receipt of copy of this order. The 2nd respondent is also given liberty to place the copy of this order before the learned Magistrate for orders, if any, for expeditious disposal. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
