HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39471 of 2017 ORDER:

The petitioner's pray for Mandamus for compliance of procedure under Section-41-A of Criminal Procedure Code. The requirements of Section-41-A of Criminal Procedure Code and also the principles laid down by the Hon'ble Supreme Court in Arnesh Kumar Vs. State of Bihar1, when are governing the field, issuing a further Mandamus, this Court is of the view, is unnecessary.

If respondent Nos.4 and 5 for any reason deviate from the procedure, they may be doing the same at their own risk and costs.

The Writ Petition is dismissed with above observations. As a sequel, Miscellaneous Petitions, if any, pending, shall stand closed.
