THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35020 OF 2017 ORDER:
The petitioner prays for the following relief: "......writ of mandamus declaring the action of the respondents in interfering with the personal liberty and property of the petitioner and his family members without being accused in any crime at the behest of ruling party big wigs to tarnish the petitioner's image is wholly illegal, arbitrary and without jurisdiction and violative of Articles 19 and 21 of Constitution of India and for a consequential order directing the respondent police not to interfere with the personal liberty.........."
The learned Government Pleader places on record notices issued under Section 160 of Criminal Procedure Code and submits that respondents are following the procedure stipulated for investigation of Crime No.123 of 2017. The averments in the affidavit are unfounded. Mr Challa Dhanamjaya, after taking note of notices issued under Section 160 of Criminal Procedure Code does not press the writ prayer.
Writ Petition is accordingly dismissed. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
